Hiatus Wellness – General Terms & Conditions

Please read these Terms and Conditions carefully. By accessing or using this website (“Site”), you agree to be legally bound by the terms below.

1. Agreement

These Terms and Conditions form a binding agreement between you and BB and Y Pty Ltd trading as Hiatus Wellness, operating in Queensland, Australia (“Hiatus Wellness”). Hiatus Wellness may update these Terms at any time. Continued use of the Site constitutes acceptance of any updated Terms.

2. Copyright

All content created by Hiatus Wellness on this Site is protected under Australian copyright law, including the Copyright Act 1968 (Cth). The absence of a copyright notice does not waive these rights.

3. Third-Party Links

This Site may contain links to third-party websites. Hiatus Wellness does not control and is not responsible for the content, accuracy, or availability of those sites, nor for any loss arising from their use. Links are provided for convenience only.

4. Use Licence

Permission is granted to download Site materials for personal, non-commercial use only. This licence does not permit you to:

  • modify or copy materials;
     

  • use materials for commercial or public purposes; or
     

  • transfer or mirror materials on another server.

This licence terminates automatically if breached. Upon termination, all downloaded materials must be destroyed.

5. Bookings, Payments & Cancellations

To ensure fair access to our services:

Bookings

  • Bookings must be paid within 24 hours of request or may be cancelled.
     

Refunds

  • Approved refunds will be credited back to the original payment method.
     

Rescheduling

  • A minimum of 60 minutes’ notice is required to reschedule.
     

Cancellations

  • Cancellations within 4 hours of the appointment may be charged up to 100% of the appointment fee.
     

  • Appointments are reserved specifically for you. Late cancellations limit availability for others.
     

  • No exceptions apply for illness.

6. Gift Cards & Packages

  • Gift cards are valid for 3 years from purchase.
     

  • Packages are valid for 12 months, unless stated otherwise (short-term offers: 1 month).
     

  • Gift cards are not replaceable, however our studio can assist in locating purchase details.
     

  • Packages are non-transferable once linked to a client account.

7. Conditions of Entry

Entry to any Hiatus Wellness studio is at our discretion. By attending, you confirm that:

  • You are 18 years or older and have signed a waiver; or
     

  • You are 10–18 years and supervised by a legal guardian who has signed a waiver; or
     

  • You are under 16 years, and only use approved services under direct guardian supervision with a signed waiver.
     

Hiatus Wellness reserves the right to verify age at any time.

8. Disclaimer

Information and services provided via this Site are for general informational and educational purposes only and do not replace professional advice. You should consult a qualified professional before acting on any information provided.

9. No Guarantees

Hiatus Wellness makes no guarantees regarding outcomes, benefits, or results from use of the Site, products, or services.

10. Limitation of Liability

To the extent permitted by law, Hiatus Wellness is not liable for any loss or damage arising from use of, or inability to use, this Site or its content.

11. Governing Law

These Terms are governed by the laws of Queensland, Australia, and the parties submit to the exclusive jurisdiction of Queensland courts.

12. Indemnity

You agree to indemnify Hiatus Wellness, its directors, and affiliates against any claims, losses, or expenses arising from your use of this Site.

13. Entire Agreement

These Terms, together with any linked policies, constitute the entire agreement between you and Hiatus Wellness. If any provision is found unenforceable, the remainder will continue in full force. Headings are for reference only.
